There’s a growing crisis in America, one that strikes at the heart of public health, constitutional rights, and the safety of our children. It’s not a flashy scandal or a hot political debate—it’s the silent, systemic failure of our federal government to protect us from outdated, unconstitutional, and blatantly ignored laws.
This isn’t just about bureaucracy. It’s about real harm: cancer, neurological damage, developmental disorders, and a future where our children and grandchildren bear the brunt of decisions made decades ago.
The FDA: Breaking Public Law 90-602
In 1968, Congress passed Public Law 90-602 (Radiation Control for Health and Safety Act), mandating the FDA to research and regulate electronic product radiation—including the radiofrequency (RF) radiation emitted by cell phones, Wi-Fi, and other wireless technologies.
The law is clear: the FDA must ensure public safety by funding research, updating guidelines, and informing the public of potential risks. Yet the FDA has ignored its legal mandate for decades. The National Toxicology Program (NTP), which conducted groundbreaking research finding clear evidence of cancer from RF radiation, was abruptly defunded under the Biden administration. This failure is not just neglect—it’s a violation of congressional law.
The FCC: Outdated and Unaccountable
The Federal Communications Commission (FCC), tasked with regulating RF exposure, is still using 1996 safety guidelines—guidelines written before smartphones, Wi-Fi, and Bluetooth even existed. These standards only consider thermal effects (tissue heating), ignoring non-thermal biological effects like DNA damage, oxidative stress, and neurological harm.
In 2021, the FCC lost a court case brought by the Environmental Health Trust and Robert F. Kennedy Jr. The court ruled that the FCC failed to justify its outdated standards in light of modern science. Yet, the FCC has done nothing. Children, who are especially vulnerable to RF radiation, remain exposed to levels of radiation deemed unsafe by today’s research.
Section 704: Silencing Communities
The Telecommunications Act of 1996, signed by President Bill Clinton, includes Section 704, which strips local governments of the ability to reject cell towers on health grounds. This law:
- Violates the First Amendment: By silencing public discourse on health risks, it denies citizens the right to petition their government.
- Violates the Tenth Amendment: By overriding local authority, it strips communities of their constitutional rights to regulate zoning and public health.
As a result, parents like me cannot protest cell towers placed mere feet from schools, playgrounds, or homes, no matter how credible the health risks.
The Real Cost: Our Children’s Health
The systemic failures of the FDA, FCC, and Section 704 aren’t just abstract issues—they’re directly impacting the health of our children. Studies have linked RF radiation to:
- Cancer: The NTP found a clear link between RF radiation and malignant tumors in lab animals.
- Neurological Damage: Yale’s study on RF-exposed mice showed signs of ADHD-like behavior.
- Developmental Disorders: Dr. Martin Pall has identified mechanisms linking RF radiation to autism and other neurological conditions.
This is more than a public health crisis—it’s a betrayal of trust.
What Needs to Happen
1. Repeal or Amend Section 704
Restore local authority to regulate wireless infrastructure and uphold constitutional rights.
2. Update FCC Guidelines
Demand modern, science-backed safety standards that consider non-thermal effects and today’s real-world RF exposures.
3. Enforce Public Law 90-602
Hold the FDA accountable for ignoring its legal duty to research and regulate RF radiation. Restart the NTP’s vital research.
