The Policy Bottleneck: Section 704
Everything begins and ends with Section 704 of the 1996 Telecommunications Act. This single provision, signed under Bill Clinton, stripped states and communities of the right to regulate tower placement on health grounds. It silenced First Amendment petition rights and overrode Tenth Amendment sovereignty. As long as Section 704 stands, schools, homes, and hospitals will remain defenseless against towers placed right on their doorstep.
Repealing Section 704 is the first and unavoidable step. Without it, all talk of “safe siting” is an illusion.
Public Law 90-602: The Forgotten Mandate
In 1968, Congress passed the Radiation Control for Health and Safety Act (Public Law 90-602). It requires the federal government to continuously research and regulate all radiation-emitting technologies. That includes microwave radiation.
Yet after the National Toxicology Program (NTP) found clear evidence of cancer in 2018, funding was cut. Enforcement of 90-602 was abandoned. That is a breach of law and duty. The Department of Health and Human Services (HHS) must be forced back into compliance — to protect Americans, not industry profits.
