According to USA Today , NY
legislation will require drivers to not directly be holding a cell phone or they
will receive a 100 dollar ticket after Dec 1 of 2001. This raises a lot of legal
questions (ie what about truckers' radios, government intervention etc). But it
does appear that a few other states may follow suit as well on this. Because
there is a question of danger to others and not just oneself this seems to be a
bit different than the seat belt legislation but it's still very controversial.

highway safety issue. States are being asked to look at the correlation between
use of cell phones while driving and crashes where driver distraction is a
causal factor.
